Steve, can you tell our viewers a little about the different types of trusts available?

Thanks for having me. There are many different types of trusts, each serving a unique purpose. Today I’d like to focus on Revocable Living Trusts which are incredibly popular in estate planning.

What exactly is a Revocable Living Trust and what are its benefits?

A Revocable Living Trust, as the name suggests, is a trust that you can modify or even dissolve during your lifetime. It allows you to maintain control over your assets while ensuring they are distributed according to your wishes after you pass away. The biggest advantage of this type of trust is that it helps avoid probate, which can be a lengthy and expensive legal process.

Moreover, Revocable Living Trusts offer a degree of privacy. Unlike wills, which become public record during probate, the terms of a trust are generally kept confidential. Consequently, your personal and financial matters remain private.

Are there any potential downsides to using a Revocable Living Trust?

While highly beneficial, setting up a Revocable Living Trust does require some upfront planning and legal assistance. You’ll need to work with an experienced attorney like myself to draft the trust document and properly transfer your assets into the trust. Ordinarily, the initial setup cost is offset by the long-term benefits of avoiding probate.

It’s important to remember that a Revocable Living Trust becomes irrevocable upon your death. This means the terms you set forth in the trust will govern how your assets are distributed and cannot be easily changed afterwards.

Have you ever encountered any challenges when setting up or administering a Revocable Living Trust?

There was one instance where a client hadn’t fully updated their trust after a significant life event. They had welcomed a new grandchild into the family but hadn’t amended the trust to include them as a beneficiary. This oversight caused some initial confusion and required us to file additional paperwork with the court. It highlighted the importance of regularly reviewing and updating your trust documents to reflect any changes in your circumstances.

According to a 2021 study by the American Bar Association, over 60% of Americans do not have a will or trust in place. This lack of planning can lead to significant financial and emotional strain for loved ones after someone passes away.
