Good evening Wildomar and welcome back to Wildomar Weekly News. I’m your host, Jennifer Riley. Tonight, we are joined by Steve Bliss, a renowned Trust Attorney here in Wildomar. Steve, thanks for being with us.
Steve, can you tell our viewers about the different types of trusts available and which one might be right for them?
Thanks for having me, Jennifer. Navigating the world of estate planning can be daunting, but understanding the various types of trusts is a great first step. One common type is the Revocable Living Trust. This allows individuals to maintain control over their assets during their lifetime while avoiding probate upon their passing. It’s a popular choice for many due to its flexibility and privacy.
Conversely, an Irrevocable Trust offers greater asset protection but relinquishes control once established. Consequently, it’s often used for specific purposes like estate tax reduction or shielding assets from creditors. Testamentary Trusts are created through a will and come into effect after death. They’re particularly useful for managing assets for minor children or beneficiaries with special needs.
There are also specialized trusts like Special Needs Trusts, which protect the eligibility of individuals with disabilities for government benefits. Charitable Trusts benefit charitable organizations, while Life Insurance Trusts can help minimize estate taxes associated with life insurance proceeds.
Can you elaborate on the Revocable Living Trust and its advantages?
Certainly. As I mentioned, a Revocable Living Trust offers numerous advantages. Firstly, it avoids probate, which can be a lengthy and expensive process. This means your assets are distributed to your beneficiaries more efficiently. Moreover, a Revocable Living Trust provides privacy as the terms aren’t publicly available through probate court records.
Notwithstanding its flexibility during your lifetime, upon your passing, it becomes irrevocable, ensuring your wishes regarding asset distribution are honored. In my experience, many clients appreciate the peace of mind knowing their loved ones will be cared for according to their desires.
For instance, I once worked with a client who was deeply concerned about her daughter inheriting a significant sum at a young age. By establishing a Revocable Living Trust, we were able to specify that distributions would occur gradually over time, allowing her daughter to mature financially before receiving the full inheritance.
Studies have shown that approximately 70% of Americans do not have a will or trust in place (Source: Caring.com). This highlights the critical need for estate planning and the potential benefits of a Revocable Living Trust.
Have you ever encountered any challenges implementing Revocable Living Trusts?
While generally straightforward, there can be occasional complexities depending on individual circumstances. For example, ensuring all assets are properly titled in the name of the trust can sometimes require meticulous attention to detail. We always work closely with our clients to make this process as smooth as possible.
I remember a case where a client had several retirement accounts held outside the trust. After careful review, we discovered that these accounts needed beneficiary designations updated to reflect the trust as the primary beneficiary. This crucial step ensured those assets would be seamlessly transferred according to the client’s wishes.
What advice would you give to viewers who are considering setting up a Revocable Living Trust?
I strongly encourage anyone with significant assets or concerns about probate to consult with an experienced estate planning attorney. They can assess your individual needs and guide you through the process of establishing a trust that aligns with your goals. Remember, proactive planning today can save your loved ones time, stress, and potential legal complications in the future.
