Today we’re chatting with Ted Cook, an elder protection attorney practicing in beautiful Point Loma, California. Ted, thanks so much for taking the time to speak with me.
What Inspired You to Focus on Elder Protection?
Ted smiles warmly. “Well, it’s a combination of factors really. Early on, I saw how vulnerable older adults can be, especially when they face financial exploitation or are in situations where their health and well-being are compromised. It struck me as crucial work that needed to be done.” He pauses thoughtfully. “Protecting our elders is not just about the law; it’s about preserving their dignity, autonomy, and quality of life.”
Can You Walk Us Through The Process of Elder Protection?
Ted pulls out a well-worn notepad. “Every case is unique, but there are some key steps we generally follow.
- Initial Client Engagement: This involves meeting the client, understanding their situation, and assessing their capacity.
- Case Assessment: We identify the legal issues at play, whether it’s financial abuse, neglect, or something else. Then we gather evidence to support the case.
- Protective Actions: This can involve anything from securing restraining orders to filing lawsuits on behalf of the client.
- Legal Proceedings: Depending on the circumstances, this may involve civil litigation, criminal proceedings, or probate court matters.
- Long-Term Planning: We help clients develop strategies to protect themselves in the future, such as through estate planning and advance directives.
- Case Resolution & Follow-Up: We work towards a resolution that is in the best interest of our client and provide ongoing support as needed.
Let’s Dive Deeper into “Protective Actions” – What Does That Encompass?
Ted nods. “This stage is often critical because it involves taking immediate steps to safeguard the elder’s well-being.
- If there’s an imminent threat, we might seek a restraining order to prevent further harm.
- “Sometimes,” Ted adds, “we need to notify Adult Protective Services (APS), who have the authority to investigate abuse and neglect.
- “In cases of severe incapacity,” he explains, “we may petition the court for guardianship or conservatorship. This allows a responsible party to make decisions on behalf of the elder who can’t do so themselves.”
“Ted was incredibly patient and understanding during a difficult time for my family. He helped us navigate a complex situation with compassion and expertise.” – Maria S., La Jolla
Ted shares an anecdote about a case where he successfully obtained a restraining order against an abusive caregiver, preventing further financial exploitation of his client. He recalls the sense of relief on his client’s face when they realized they were finally safe.
Do You Ever Encounter Challenges During “Protective Actions”?
Ted chuckles softly. “Every case has its hurdles. One challenge I often face is convincing hesitant family members that intervention is necessary.”
“I was so lost when my mother became a victim of financial abuse. Ted guided me through the legal process and helped me recover some of her stolen assets.” – John B., Point Loma
He describes a case where adult children were initially reluctant to believe their parent was being exploited. “It took time and patience to build trust and help them understand the gravity of the situation,” he recalls.
What Would You Say To Readers Who Might Need Your Services?
Ted leans back in his chair, a thoughtful expression on his face. “If you suspect an elder is being abused or neglected, please don’t hesitate to reach out. There are resources available to help, and you don’t have to go through this alone. Remember, every elder deserves to live with dignity and respect.”
“Ted Cook is a true advocate for seniors. He’s compassionate, knowledgeable, and dedicated to protecting his clients.” – Susan L., San Diego
