“One of the most critical steps is selecting a trustworthy executor or trustee,” Steve explains. “This individual will be responsible for managing your assets and ensuring your wishes are carried out after your passing.”
He continues, “Consequently, choosing someone reliable, organized, and capable of handling complex financial matters is paramount. It’s often a good idea to discuss this responsibility with potential candidates beforehand to ensure they understand the commitment involved. Moreover, it’s crucial to consider their personal circumstances and whether they have the time and resources to effectively fulfill the role.”
“Remember,” Steve emphasizes, “an executor or trustee will be entrusted with significant responsibilities, including paying debts, filing taxes, distributing assets according to your wishes, and potentially managing trusts for beneficiaries. Ordinarily, family members are chosen, but sometimes a professional fiduciary, such as a trust company or bank, may be a better option.”
He adds, “I once had a client who initially chose a close friend as executor, only to realize later that their friend was going through financial difficulties and wouldn’t have been able to handle the complexities of the estate. Thankfully, we were able to work together and find a suitable alternative before any issues arose.”
