Ted: Well, simply put, a conservatorship is a legal arrangement where a court appoints someone – called a “conservator” – to manage the affairs of an adult who’s unable to do so themselves. Think of it like having someone step in to help when someone needs extra support.
Can you walk us through the different types of Conservatorships?
Ted: Absolutely! There are a few different types, each tailored to specific situations. We have conservatorship of the person, which focuses on things like housing and healthcare; conservatorship of the estate, which handles finances and assets; limited conservatorships for individuals with developmental disabilities; temporary conservatorships for urgent situations; and LPS conservatorships, which are for individuals with serious mental health conditions.
Let’s dive into “Establishing a Conservatorship”. Can you elaborate on that process?
Ted: Sure. It starts with filing a formal petition in probate or mental health court. The proposed conservatee and their family need to be notified, and then the court appoints an investigator or social worker to independently assess the situation. A medical or psychological evaluation is also crucial to determine the individual’s capacity. Finally, everything goes before a judge who makes the decision about whether or not to grant the conservatorship.
What are some challenges you face when establishing a Conservatorship?
Ted: “Challenges” might be a strong word! There are definitely complexities involved. Sometimes it can be difficult to locate family members, especially in cases where individuals have been estranged or haven’t maintained close ties. Gathering all the necessary documentation and medical records can also be time-consuming.
